PRIVACY POLICY

Definitions

In this document, unless the context indicates otherwise, the words and expressions set out below shall have the meanings assigned to them and cognate expressions shall have a corresponding meaning, namely –

“Eezifit” means Foshan Trading (Pty) Ltd 2006/000408/07 trading as Eezifit;

“Personal Information” shall have the meaning ascribed thereto in terms of section 1 of POPI, namely: any information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to – information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, wellbeing, disability, religion, conscience, belief, culture, language and birth of the person; information relating to the education or the medical, financial, criminal or employment history of the person; any identifying number, symbol, e-mail address, telephone number, location information, online identifier or other particular assignment to the person; the biometric information of the person; the personal opinions, views or preferences of the person; correspondence sent by the person that would reveal the contents of the original correspondence; the views or opinions of another individual regarding the person; and the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person;

“Policy” means this privacy policy;

“POPI” means the Protection of Personal Information Act No. 4 of 2013;

“Processing” means any operation or activity or any set of operations, whether or not by automatic means, concerning Personal Information, including:

the collection receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use;
dissemination by means of transmission, distribution or making available in any other form; and
merging, linking as well as restriction, degradation, erasure or destruction of information; and

“Website” shall mean Eezifit’s website with the following link, https://eezifit.co.za/.

Introduction

Eezifit takes the privacy of all persons who access, visit and utilise its Website and register for and/or open an account with Eezifit, seriously and is committed to protecting your Personal Information.

This Policy deals with the manner in which Eezifit processes Personal Information which is collected from you and the purpose of such Processing.

Personal Information collected

In order for Eezifit to provide you with its products and services, Eezifit collects documentation/information that relates specifically to you and that can identify you, which documentation/information includes but is not limited to –

name and surname;
age;
identity number;
date of birth;
email address;
telephone number ;
physical and/or postal address;
financial information such as banking details and payment card details;
device information;
location information; and
transactional information.

Eezifit may collect and process Personal Information that you provide to it when visiting, downloading, subscribing and/or registering on the Website, and/or using any service or product that Eezifit currently offers and/or may offer in the future; Personal Information that you provide when reporting a problem, lodging a complaint and/or a query in respect of the Website and/or services or products that Eezifit currently offers and may offer in the future.

Eezifit also collects, processes and discloses general, statistical, aggregated or anonymised information which does not constitute Personal Information. You hereby consent to the collection, processing and disclosure of such general, statistical, aggregated or anonymised information as Eezifit deems fit.

Eezifit shall endeavour to only collect and process Personal Information relating to you which is adequate, relevant, and not excessive in terms of POPI and which is required by Eezifit to provide you with the required products and services.

Eezifit shall endeavour to inform you of the information which is required for Eezifit to adequately render the required services to you and which information is optional but may still be useful to Eezifit for the provision of its products and services.

Use of Personal Information

Eezifit shall only process your Personal Information if the Processing is –

necessary to carry out its obligations in terms of an engagement between you and Eezifit;
consented to by you;
required for Eezifit to comply with its obligations imposed by law, including under the Financial Intelligence Centre Act No. 38 of 2001;
necessary to protect a legitimate interest of yours; and
necessary to pursue the legitimate interests of Eezifit or of a third party to whom the information is supplied.

Eezifit shall only use your Personal Information for the purpose for which the information was collected which purpose may include, but is not limited to, the following:

providing the Website to you;
providing any products and/or services to you;
handling your order and delivering products to you;
operating, improving and updating the Website, products and services;
providing you with customer service of any nature;
providing you with important information regarding the Website, products and/or services;
informing you of any changes to Eezifit’s technical notices, updates, security alerts, support, administrative messages or any changes to any service;
conducting audits, data analysis, development, research and/or any other business purpose that Eezifitgear deems reasonable and necessary in its sole and absolute discretion;
payment verification and the detection and prevention of fraud, money laundering or other prohibited practices purposes;
to otherwise identify you;
to respond to any queries or complaints lodged by you and/or any other third party;
carrying out any administrative functions;
processing in connection with legal proceedings; and
establishing, exercising or defending Eezifit’s legal rights.

Disclosure of Personal Information

Eezifit may disclose any and all of your Personal Information to achieve any of the purposes set forth in the above “Use of Personal Information” section of this Policy to any of its agents, service providers and/or third parties that provide any services to Eezifit and which services Eezifit requires to provide its products and services you, including but not limited to the delivery service utilised to have your product delivered to you.

Eezifit undertakes to ensure that any affiliates or third-party service providers to which Personal Information is disclosed comply with the necessary confidentiality, Processing and privacy standards set out by POPI and this Policy.

Eezifit may obtain information regarding you from third parties for the reasons set out in this Policy.

Eezifit may disclose your Personal Information where it is required to do so in terms of law or where it is necessary to protect its rights.

Security and Safeguards

Eezifit understands the value of your Personal Information and therefore shall continuously review its internal security measures and processes to prevent Personal Information from loss of, damage to, misuse, alteration or unlawful access to your Personal Information.

Eezifit shall have due regard to generally accepted information security practices and procedures.

Eezifit shall take all reasonable steps to prevent any loss of, damage to, or unlawful access to your Personal Information.

Your Personal Information is stored in databases that have built-in safeguards and firewalls to ensure the privacy and confidentiality of that information.

Eezifit stores data in encrypted form on computers and control access via secure web pages. Eezifit is assured by its service provider that it employs firewalls and other security technologies to protect its servers from external attack.

Should any data breach occur in relation to your Personal Information, Ezifit shall notify you thereof and implement the necessary recovery procedures to retrieve such information and mitigate the effect of such data breach.

Information Officer

The Eezifit information officer is Naidene Fok (“Information Officer”).

The Information Officer is responsible for Eezifit’s compliance with POPI and ensuring the lawful Processing of your Personal Information.

Access and Correction of Personal Information

You have the right to access your Personal Information which is held by Eezifit.

You have the right to request that Eezifit update, correct or delete any Personal Information held by Eezifit and Eezifit shall endeavour to comply with the request as soon as reasonably practicable.

Should you object to the Processing of your Personal Information and inform Eezifit thereof, Eezifit shall no longer process such Personal Information unless required to do so by law.

Eezifit shall request and verify the identity of the requesting party prior to giving effect to any requests made in terms of this Policy.

All requests made by you in terms of this clause shall be directed to the Information Officer.

Consent

By consenting to Eezifit’s terms and conditions when you register with Eezifit and by browsing and/or making use of its website, you expressly consent to this Policy governing your use of the Website; Eezifit’s collection, processing and disclosure of your Personal Information as set out in this Policy; and the use of cookies on the Website, if and when applicable.

If you do not accept Eezifit’s terms and conditions, you shall not make use of Eezifit’s services or access the Website.

Changes to this Policy

Eezifit reserves the right, in its sole and absolute discretion, to update, modify or amend (including without limitation, by the addition of new terms and conditions) this Policy as and when required.

Applicable Laws

This Policy will be governed by and construed and interpreted in accordance with the laws of South Africa.
